The Texas Data Privacy and Security Act (in force since July 1, 2024) has no revenue or volume threshold but, like other non-California state privacy laws, does not reach B2B contact data. The bigger outbound factor is SB 140 (effective September 1, 2025), which brought text and image messages within Texas's telephone-solicitation rules and made telemarketing violations actionable under the Texas DTPA, so SMS steps in Texas sequences need consent and legal review alongside CAN-SPAM and the TCPA.

Buyer notes
