The bigger outbound factor is SB 140 (effective September 1, 2025), which brought text and image messages within Texas's telephone-solicitation rules and made telemarketing violations actionable under the Texas DTPA, so SMS steps in Texas sequences need consent and legal review alongside CAN-SPAM and the TCPA.
